California's Parking Cash-Out Law

• Requires certain employers to offer a cash allowance instead of parking space.

• If the space is owned by the employer and offered to the employee for free, no parking cash-out program is required. The law applies to employers (public or private) that: 

  • Employ at least 50 persons in the state;

  • Have worksites in an air basin designated nonattainment (see Ozone, PM2.5, PM10); and

  • Provide a parking subsidy to employees (including allowing employees to park for free in a leased parking space).
